Manufacturer Cites Appellate Ruling in Bid to Undo Class Status
Aerotech Inc., a Pittsburgh-based motion systems manufacturer, has asked a federal judge to decertify a class of about 500 participants in its employee stock ownership plan, citing a recent appeals court decision that casts doubt on class certification in benefit plan disputes. The company argues that the plaintiffs’ preferred investment strategy would benefit younger class members at the expense of those nearing retirement, making it impossible to resolve the case on a class-wide basis. The request was reported by Bloomberg Law.
